Knoxville Movement Collective (KMC) Terms and Conditions & Liability Waiver

1. Acceptance of Terms

By participating in any Knoxville Movement Collective (KMC) activities or events, you acknowledge that you have read, understand, and agree to abide by these Terms and Conditions, including the Liability Waiver set forth below. If you do not agree, please do not participate in KMC activities.

2. Eligibility

Participants must be at least 18 years old (or have parental consent if under 18) to participate in KMC activities.

3. Code of Conduct

Participants are expected to treat others with respect, exercise caution and good judgment, and follow any instructions provided by KMC staff or volunteers during activities. Harassment, discrimination, or unsafe behavior will not be tolerated and may result in removal from KMC activities.

4. Assumption of RisK

Participation in KMC activities, including but not limited to running, walking, hiking, and other outdoor fitness events, involves inherent risks of injury, illness, property damage, or death. By participating, you voluntarily assume all risks, whether known or unknown, associated with participation in KMC activities.

5. Liability Waiver and Release

You hereby release, discharge, and hold harmless KMC, its organizers, volunteers, sponsors, and partners from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to any injury, damage, or loss you may suffer as a result of your participation in KMC activities, even if arising from the negligence of KMC or its representatives.

6. Medical Treatment Authorization

In the event of an injury or medical emergency, you authorize KMC representatives to secure medical treatment on your behalf. You agree to be financially responsible for any costs incurred as a result of such treatment.

7. Photo and Media Release

You grant KMC permission to use photographs, videos, and other media taken during KMC activities for promotional purposes, including social media, websites, and other marketing materials.

8. Privacy

KMC respects your privacy. We collect and store personal information solely for the purposes of communication, activity planning, and safety. We do not sell or share your information with third parties except as required by law.

9. Governing LaW

These Terms and Conditions, including the Liability Waiver, shall be governed by and interpreted in accordance with the laws of the State of Tennessee. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10. Agreement

By checking the box on the KMC new member form, joining KMC, or by attending any KMC event or activity, you acknowledge that you have read, understand, and agree to these Terms and Conditions, including the Liability Waiver.
